Dear Mr. D. M.,

I have reviewed the available facts surrounding the recent incident at Peterson Field 620­the lower turf field­ in which, at approximately 10:50p.m. on March 23, 2009, you displayed unsportsmanlike behavior and threw a water bottle & hit another player from the opposing team. I have personally consulted with the ARC Intramural Supervisor who was on-duty at the time, spoke to the Intramural officials and spoke with witnesses of the incident.

I have studied the Intramural Sports Handbook of Rules and Regulations and have determined your actions violate several Intramural policies. For your convenience, these sections are outlined below:

E. Fighting
Any participant, who in the judgment of Intramural Sports Staff, engages in any attempt to
fight (strikes or engages an opponent in a combative manner, throws a punch, kicks an
individual, and/or retaliates against an aggressive act) immediately before, during or after an
Intramural Sports contest shall be suspended from further participation in the Intramural
Sports Program for one year (365 days).

Penalty- Any team using a suspended player will forfeit all games in which the suspended player participated. Any team knowingly using such a player will be ineligible for competition for one year and player’s team may not advance to the playoffs.

In accordance with the above policy and in the opinion of the Intramural Sports department, you have been suspended from all Intramural events and contests for one (1) year from Intramural Sports. You will not be permitted to participate in any Intramural contest until after 3/24/10.

If you would like to file an appeal of this action, you have two (2) business days from the time you receive your notice to do so. Please mail or fax a written letter of appeal within 48 hours of receipt of this correspondence to me. All written appeals will be reviewed by the professional staff and forwarded to the Judicial Committee of the A.S. Recreation Board. If necessary, a hearing will be held at the next available board meeting in regards to your suspension. A recommendation to uphold an appeal requires approval by a majority of the entire A.S. Recreation Board.

Dear Mr. Schaffer:

I wish to appeal my one-year suspension from participation in Intramural Events and Contests. You have taken this action without allowing me the opportunity to respond to the alleged charges and I respectfully request a hearing in front of the Judicial Committee of the A.S. Recreation Board. I have not been allowed to offer any defense on my own behalf. As I understand the rules of law in this country, I should have this right.

I believe in good sportsmanship and have always tried to practice it at all times when involved in sporting activities. As a Brazilian student, I also try to leave a good impression of my country and the sport that I love. I admit that my actions on the evening of March 23, 2009 did not measure up to the standards to which I aspire, but I specifically refute the charges that I engaged in an attempt to fight, strike, or throw a punch, nor did I kick or retaliate against another player as you have alleged. During the match I was the subject of constant verbal taunts and assaults, including sexual innuendos by the other party. Unfortunately, he was able to “push my buttons” to the extent necessary to affect my play to the point of my being issued a yellow card during the soccer match. At the conclusion of the game, the other party attempted to engage me in a fight. I was not the protagonist; rather I was one who was the subject of an aggressive act. In refusing to fight him, I uttered a profanity and was immediately surrounded by him and his teammates. It was at this time that the Supervisor and other Intramural Officials became aware of the altercation. They were not privy to the previous events, the verbal and sexual abuse during the game, or the attempt by the other student to engage me in a fight. All they saw was a group of angry students gathering around me, and they heard me utter the profanity.

I am a frequent user of the ARC facilities, and I participate in indoor soccer matches at least three times each week. There are numerous students who can and will testify that I display and practice good sportsmanship at all time during these games. The event of March 23 was an isolated incident that will not be repeated. I respectfully request that you rescind my suspension.

Bom e velho cagado. Eu testemunharia em teu favor, certamente: "I couldn`t deny to say that I never didn`t see this bloke not acting in the opposite way a sportsman should... shouldn`t..."

Bah, os caras são muito bandidos. Claramente admitiram que tu foi MOLESTADO no jogo e não fizeram nada contra teus agressores. Pena de um ano passada pra DOIS DIAS é muito atestado de derrota.
